Seller Agreement

Terms for sellers listing horses and advertisements on WinnersOver.

Seller Agreement — draft for review. These terms should be reviewed by a qualified attorney before being used as a binding agreement. The website does not yet require electronic acceptance.

1. Listings and fees

By submitting a listing for approval, a seller agrees to the applicable fees shown on the Fees & Pricing page. Paid listing fees are due before a listing is submitted for administrator approval, except when a valid free-launch promotion applies. Submission does not guarantee approval.

Regular private horse-for-sale advertisements run for 120 days. The upfront fee is $20 for horses advertised at $1,500 or less, or $50 for horses advertised above $1,500.

2. Private-sale commission

When a horse advertised for private sale through WinnersOver sells for more than $6,000, the seller agrees to pay WinnersOver a commission of 1% of the entire final selling price, not merely the amount above $6,000. This commission is separate from the upfront listing fee.

For a final sale price of $6,000 or less, no percentage commission is due. Example: a $10,000 private sale incurs a $100 commission.

3. Reporting and payment

The seller agrees to notify WinnersOver promptly when an advertised horse sells and to accurately report the final selling price, including when buyer and seller arrange the transaction directly. Any applicable private-sale commission must be paid within seven (7) calendar days after the sale. WinnersOver may provide an invoice or payment instructions.

4. Other advertisements and optional promotions

Breeding advertisements cost $50 for 120 days with no sale commission. Buyer Wanted advertisements cost $10 for 60 days with no sale commission. Featured placements and banner advertisements are optional paid promotions. Photos and videos are included without additional upload fees.

5. Discounts and launch offer

Eligible horse listings and auctions may qualify for a limited launch offer, bulk submission discount, or every-fifth-paid-listing reward as described on the pricing page. Discounts do not stack; the highest eligible discount applies to the upfront listing fee only. Optional advertising and commissions are excluded.

6. Seller acknowledgments

The seller is responsible for providing truthful and accurate listing information and for complying with applicable laws. WinnersOver may review listings before publication. Any refunds, disputes, cancellations, and other rights must be governed by additional published terms and applicable law.

Planned acceptance step: Before submitting a listing, sellers will be required to check a box confirming that they have read and agree to the Seller Agreement, including applicable fees due after a sale. This acceptance feature has not yet been implemented.
