WinnersOver is an online marketplace where users may list horses for sale or auction, view listings, and submit bids. WinnersOver is not automatically a party to any sale between users unless it expressly agrees otherwise in writing.
Members must provide accurate account information, keep their credentials secure, and use the service lawfully. Users must have legal capacity to enter into transactions and must not misrepresent their identity or authority.
Users must provide truthful information. Sellers are responsible for their listings and buyers for reviewing the available information. Auction bids may create binding obligations under the Buyer and Seller Agreement and applicable law.
Fraud, false listings, bid manipulation, impersonation, harassment, unauthorized access, and use of another person's account are prohibited.
Features, availability, and policies may change. The site may review, reject, or remove listings and suspend accounts for suspected violations, subject to applicable law.
Buyers and sellers are responsible for agreeing on payment, horse inspection, transfer, shipping, and documentation. The platform does not guarantee a horse's health, performance, ownership, or the completion of a transaction.
Before launch, counsel should finalize the operator's legal name and address, contact details, applicable governing law, consumer protections, disclaimers, liability limits, dispute procedures, and any applicable fees.
